Live Chat and WhatsApp for Business Terms of Use

Live Chat and WhatsApp for Business are facilities established and maintained by LivePerson, Inc. a company headquartered in New York City, USA ("LivePerson"). These Terms of Use govern your access to and use of Live Chat and WhatsApp and contain important information about how Now Health International (“Now Health” or “We”) and LivePerson will access and use Personal Information about you for the purpose of providing this service. Your use of Live Chat and WhatsApp constitutes acceptance of these Terms of Use.

The Use of Live Chat and WhatsApp

Live Chat enables live customer service representatives in service centres to interact with Now Health members and other individual users through pop-up windows on screen on Now Health’s public, quoting and secure online portfolio websites www.now-health.com, quote.now-health.com, broker.now-health.com, www.now-health.com/portfolio.

WhatsApp enables live customer service representatives in service centres to interact with Now Health members and other individual users through links from the mobile version of the Now Health public website (www.now-health.com), the Now Health mobile app and directly through WhatsApp using Now Health’s WhatsApp for Business account.

Now Health provides this service for the purpose of providing help and support with respect to Now Health’s general products and services, and subject to completing a satisfactory data protection check, provide personalised information about the utilisation of your plan.

You must only use Live Chat and WhatsApp for the purposes described in these Terms of Use. You must not use or attempt to use Live Chat and WhatsApp to:

  1. Adversely affect the reputation of Now Health or LivePerson
  2. Damage or interfere with Live Chat or WhatsApp data, software, website or information technology systems;
  3. Send any offensive, inflammatory, defamatory, fraudulent or otherwise unlawful information; or
  4. Cause annoyance or inconvenience to Now Health or LivePerson.

You acknowledge that Now Health can terminate your use of Live Chat and WhatsApp if Now Health reasonably believes that you have breached these Terms of Use.

Privacy

To use Live Chat and WhatsApp, Now Health will ask you to provide partial information about yourself.  Should you require access to sensitive personal information, including personal health information, you will be asked to provide further security information.

If you provide your personal information to Now Health, Now Health may collect, use, store and disclose your personal information in accordance with Now Health’s Privacy Policy and Now Health’s website Conditions of Use.  

For the purpose of ensuring the smooth running of the system, we may disclose the contents of the Live Chat communication (including any personal information and personal health information you provide to us when using Live Chat and WhatsApp) to our service provider LivePerson. Now Health has in place contractual arrangements with LivePerson for the protection of personal information.

To preserve your confidentiality, Now Health will not disclose or ask you to disclose any sensitive personal information or personal health information when using Live Chat and WhatsApp unless you have successfully completed a data protection check.

WhatsApp users should disable lock screen notifications from Now Health to keep sensitive personal information and personal health information private.

Transcripts and Records 

For quality and verification purposes, Now Health will retain a transcript of all communications with you via Live Chat and WhatsApp. This information will be retained by Now Health for a period of seven years (or such other period as defined by local regulators) from the day upon which Live Chat or WhatsApp communication took place.

Warranties/Limited Liability

To the extent permitted by law, Now Health excludes all implied representations, conditions and warranties whether statutory or otherwise.

Now Health will not be liable to you or any other party for any actions, proceedings, claims, losses or damages suffered by you arising from or connected with your use of Live Chat and WhatsApp or indirect or consequential loss or for loss or corruption of data, loss of revenue or loss of profits, whether in contract, tort or under statute or otherwise arising from or connected with your use of Live Chat and WhatsApp.

Your right of recovery under these terms of use is cumulative.

Governing Law and Governing Version

Hong Kong Special Administrative Region (“Hong Kong”). You agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong. You further agree that these terms of use may be enforced in the courts of any competent jurisdiction.
